1. Acceptance

By accessing or using VibePost AI ("Service," "we," "our"), you agree to these Terms and our Privacy Policy. If you disagree, you must not use the Service.

2. Service Description

VibePost AI provides AI-powered tools designed for creating short-form video content, including hook with demo video feature, AI UGC avatar creation, and Hooks generation. Features described as upcoming or in beta are subject to modification or removal without prior notice.

3. Account Terms

You agree to:

• Provide accurate account information.
• Maintain the confidentiality and security of your account.
• Promptly notify us at Contact@vibepost.app of any unauthorized account access or security breaches.

4. User Content & License

You retain ownership of all content uploaded or generated on our platform, except AI-generated avatars. You grant us a limited, revocable, worldwide license to process your content strictly to provide the Service.

5. Data Retention and Account Management

• Retention: We retain basic user details (such as name, email, and user ID) and generated content indefinitely.
• Sensitive Information: We do not store any sensitive or confidential information.
• Account Deletion: To request account deletion and the removal of your data, please contact Contact@vibepost.app
• Backups: User data is not backed up separately.

6. Acceptable Use

You agree not to:

• Violate applicable laws, regulations, third-party rights, or platform community guidelines.
• Upload or create content that is offensive, hateful, violent, deceptive, or otherwise harmful.
• Attempt to reverse-engineer, scrape, disrupt, or interfere with our infrastructure or services.

7. AI Output Disclaimer

All AI-generated scripts, avatars, and video content may include inaccuracies or unintended errors. It is your responsibility to thoroughly review all generated content before use or publication.

8. Beta & Preview Features

Features labeled "Beta," "Coming Soon," or similarly are provided on an as-is basis and may be changed, interrupted, or withdrawn at our sole discretion.

9. Service Disruptions

In case of significant service disruptions:

• Complimentary video credits may be provided at our discretion.
• No monetary refunds or reimbursements will be provided for interruptions.

10. Eligibility

To use the Service, you must be at least 18 years old and have the legal capacity to enter into binding agreements.

11. Subscription and Billing

• Billing occurs monthly, and subscriptions may be canceled at any time.
• Refunds, if applicable, will be provided solely as video credits.
• AI-generated content is non-refundable once created, and credits used for such content are not restorable.

12. Intellectual Property

The VibePost AI name and logo are protected trademarks. You retain ownership of your created content except for AI avatars. AI avatars created using the Service become part of our shared asset library, and you grant VibePost AI and its users a perpetual, worldwide license to use and modify these avatars within the platform.

13. Security and Privacy

We employ commercially reasonable security measures to protect your data; however, no system is entirely secure. By using our Service, you acknowledge and accept the inherent risks of transmitting data online. We encourage you to review our Privacy Policy to understand how we collect, use, and protect your personal information.

14. Limitation of Liability

Our liability is limited to the total amount paid by you over the previous 6 months. We are not liable for indirect, consequential, or incidental damages, including lost profits or goodwill.

15. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us; we will erase your data within 30 days unless retention is mandated by law.

16. Governing Law & Jurisdiction

These Terms are governed by Indian law, and any disputes arising shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of material changes via email or through service notifications. Claims must be filed within 24 hours of the incident in question.
